Terms of Service

Effective Date: October 17, 2026 · VYDAL Home Inc.

Welcome to VYDAL. By accessing or using the VYDAL web application, mobile applications, or marketing website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") with VYDAL Home Inc. ("VYDAL," "we," "our," or "us"), a corporation organized under the laws of the Commonwealth of Virginia.

PLEASE READ THESE TERMS CAREFULLY. SECTION 8 CONTAINS A BINDING INDIVIDUAL ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT HOW DISPUTES BETWEEN YOU AND VYDAL ARE RESOLVED.

1. Informational Nature & Preventative Care Disclaimers

VYDAL provides educational home maintenance schedules, weather preparation checklists, diagnostic troubleshooting prompts, and record-keeping tools. VYDAL is not a licensed general contractor, structural engineer, electrician, plumber, HVAC technician, home inspector, or insurance carrier.

Informational Purposes Only: The Service does not provide certified architectural, engineering, or licensed trade advice.
No Guarantee Against Failure: Weather checklists and maintenance schedules significantly reduce mechanical wear, but VYDAL cannot guarantee that equipment breakdowns, flooding, pipe bursts, freeze damage, fires, roof leaks, or property loss will not occur.

2. Physical Safety & Assumption of Risk (High-Risk DIY Warning)

Working on residential mechanical, electrical, gas, pressurized plumbing, water heating, or roofing systems involves inherent risks of electrocution, explosion, fire, gas inhalation, structural falls, chemical burns, flooding, severe bodily injury, or death.

YOU EXPRESSLY ASSUME ALL RISKS associated with inspecting, maintaining, or repairing equipment. You agree to strictly follow your equipment manufacturer's official manual, shut off all relevant circuit breakers and fuel/water supply valves before touching systems, use OSHA-compliant fall protection on ladders and roofs, and hire a licensed, insured trade professional whenever a task exceeds your skills or when local building codes require licensed work.

3. AI & Diagnostic Guidance Disclaimer

Diagnostic troubleshooting assistance, optical character recognition (OCR), error code interpretations, and automated manual excerpts provided by VYDAL are algorithmic suggestions generated by machine learning models and automated web search. They are probabilistic inferences, not certified mechanical diagnoses or repair mandates. You remain solely responsible for verifying equipment issues with qualified technicians.

4. Home Record & Export Disclaimers

The VYDAL Home Record PDF and maintenance log reflect information, dates, notes, and photos entered by you or your invited household members and service pros. VYDAL does not physically inspect your property and does not certify the physical or structural condition of your home for real estate disclosures, municipal certificates, home inspections, warranty claims, or insurance underwriting.

5. Pro Marketplaces & Affiliate Disclosures

In accordance with FTC guidelines (16 CFR Part 255), VYDAL discloses that it may receive referral commissions or partner fees when you click links to third-party marketplaces (such as Thumbtack or TaskRabbit) or purchase recommended tools via affiliate links (such as Amazon Associates) at no extra cost to you.

VYDAL is an independent software platform and does not employ, license, screen, or guarantee third-party service professionals. Any service agreement or warranty is strictly between you and the independent contractor.

6. Account Security & Acceptable Use

You agree to provide accurate information and to keep your authentication credentials secure. You may not attempt to reverse-engineer the Service, bypass Row-Level Security controls, or use automated scrapers against VYDAL infrastructure.

7. Limitation of Liability

To the maximum extent permitted by applicable law, VYDAL Home Inc. and its officers, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including property damage, water damage, equipment failure, or loss of home equity, arising out of or related to your use of or reliance on the Service.

Liability Cap: In no event shall VYDAL's total cumulative liability for all claims relating to the Service exceed the greater of: (A) the total amount paid by you to VYDAL in the twelve (12) months preceding the claim, or (B) one hundred United States dollars ($100.00 USD).

8. Binding Individual Arbitration & Class Action Waiver

Informal Resolution: Before initiating arbitration, you and VYDAL agree to attempt to resolve any dispute informally for 30 days by emailing legal@vydalhome.com.

Arbitration Agreement: If unresolved, any dispute arising out of these Terms or the Service shall be settled by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules in accordance with the Federal Arbitration Act (FAA).

Class Action Waiver: YOU AND VYDAL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

30-Day Opt-Out: You have the right to opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing legal@vydalhome.com with your full name and a clear statement of opt-out.

9. Governing Law & Contact
